Terms of Use

The Member Agreement below is effective for all members.

Welcome to DishingTheDirt.co.uk ("the Site"). The one and only Internet Dating and Services Directory! Access to and use of the Site is provided by Dishing the Dirt LLP subject to the following terms:

  1. By using the Site you agree to be legally bound by these terms which shall take effect immediately on your first accessing the Site. If you do not accept the terms you are prohibited from use of or access to the Site.
  2. Please read these terms and conditions carefully to be sure that you understand them. Once you have completed your online registration procedure, your membership has been activated and you have entered into a legally binding contract for the provision of this Directory.
  3. We may change these terms at any time by posting the changes online. Please review these terms regularly to ensure you are aware of any changes. Your continued use of the Site after the changes are posted means you agree to be legally bound by the terms as updated or amended.

The Directory is for the personal use of individual members only.

  1. Eligibility

    1. You must be eighteen (18) or over and resident within the United Kingdom to register as a member of DishingTheDirt.co.uk or use the Site. By using this DishingTheDirt.co.uk Web site, you represent and warrant that you have the right, authority and capacity to enter into this Agreement and to abide by the terms and conditions of this Agreement.
  2. Registration and Subscription

    1. Although you may register as a member of the Site for free, and dish the dirt for free, if you wish to search, see pictures, read comments or communicate with other members you must become a subscriber and pay the fees as shown. You will automatically become a member of the Site once you complete and submit the registration form and shall thereafter, unless and until you or we terminate your membership, be entitled to access the Site and receive the benefits of membership as set out on the Site. One month subscription of the Site is defined as 30 days starting from the date of purchase for the fees as set out on the Site. This fee is part of this contract. We can change the subscription fees for the Site at any time but we will give you reasonable notice of this before we do so. If you are unhappy with any subscription fee changes, you may terminate your subscription at any time but no refund will be made of fees already paid. Payment must be made in advance by [credit or debit card] and you should follow the procedure set out on our subscription page.
    2. We reserve the right at our sole discretion to refuse to accept your subscription or cancel your subscription at any time. If your subscription application is accepted we will confirm this by email to the address you have given us on registration.
    3. You undertake that all the details you provide us with in connection with your registration or subscription application will be correct, that the credit or debit card is your own and that you have sufficient funds or facilities to pay all amounts due. We reserve the right to obtain validation of your credit or debit card.
    4. We will continue to collect your monthly subscription fee until such time as you give us notice in writing you wish to cancel your subscription. You must give us not less than [10] working days' notice in the event you wish to cancel.
    5. If you fail to pay us any sum due you will be liable to pay interest to us on such sum from the date due for payment at an annual rate of 3% above the base lending rate from time to time of Barclays Bank Plc accruing on a daily basis until payment is received in cleared funds whether before or after any judgement.
    6. In the event you fail to pay subscription fees due for any two months we reserve the right to terminate your subscription forthwith by written notice to the email address you provided to us on registration following which your subscription will be immediately terminated, but you will remain a member unless we notify you otherwise.
    7. You may cancel your subscription within 7 working days of making your application for any reason (including changing your mind). To do so you must contact us on [address]. You will then be entitled to a refund of your subscription fees which we will pay within 30 days of receipt of your notice and we will immediately on receipt of your notice disable your account and subscription benefits. Please note however you may only exercise your right to cancel prior to starting to use the subscription services and will lose your right to cancel and obtain a full refund as soon as you access or use any of the services that are available to subscribers only. If you wish to terminate your account once you have accessed the subscription services you must do so in accordance with clause 3.2
  3. Terms and Termination

    1. This Agreement will remain in full force and effect while you are a member of the Site.
    2. You may terminate your subscription or membership at any time, for any reason, by closing or amending your account on the Log-in page. In the event you terminate, subject to clause 2.7 above, you will not be entitled to any refund of any fees paid. Your access to the subscription services or membership services (as applicable) will cease with immediate effect and we shall not be obliged to retain any information, data or postings you have made, but at our discretion may continue to display them or delete them as we think fit.
    3. We may immediately terminate your membership and/or your subscription at any time and will send you notice of termination at the email address you provide in your application for membership or such other email address as you may later provide to us.
  4. Contributions to the Site

    1. Where you submit any contribution (including without limitation any text, photographs, graphics, video or audio) you agree, by submitting your contribution, to grant us a perpetual, royalty-free, non-exclusive, sub-licensable right and licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, play, make available to the public, and exercise all copyright and publicity rights with respect to your contribution worldwide and/or to incorporate your contribution in our works in any media now known or later developed for the full term of any rights that may exist in your contribution. If you do not want to grant to us the rights set out above, please do not submit your contribution to us.
    2. Further to clause 4.1, by submitting your contribution to us, you warrant that your contribution:
      1. is your own original work (or you have obtained all necessary permissions to use it) and that you have the right to make it available to us for all the purposes specified above;
      2. is not defamatory;
      3. does not infringe any law; and
      4. is truthful and accurate and free from errors.
    3. You shall indemnify us against all legal fees, damages and other expenses that may be incurred by us as a result of your breach of the above warranty.
    4. You agree to comply with the following rules:

      • Contributions must be civil and tasteful
      • No disruptive, offensive or abusive behaviour: contributions must be constructive and polite, not mean-spirited or contributed with the intention of causing trouble;
      • No unlawful or objectionable content: unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented, racially offensive or otherwise objectionable material is not acceptable.
      • If you use multiple logins for the purpose of disrupting the community or annoying other users you may have action taken against your account, including without limitation suspension or banning from the Site.
      • Be patient: users of all ages and abilities may be taking part in discussions.
      • No spamming or off-topic material.
      • No advertising or solicitation of others to buy or use specific products or services.
      • No impersonation.
      • No inappropriate (e.g. vulgar, offensive etc.) user names or postings.
      • No transmission of chain letters, spam or junk mail, nor any mischievous or malicious behaviour which causes or may cause damage to the Site or any third party user.
      • No attempt to bypass any registration, subscription or security processes or measures on the Site.
      • You may not submit any defamatory or illegal material of any nature.
      • This includes text, graphics, video, programmes or audio.
      • Contributing material with the intention of committing or promoting an illegal act is strictly prohibited.
      • You agree to only submit materials which are your own original work.
      • You must not violate, plagiarise, or infringe the rights of third parties including copyright, trade mark, trade secrets, privacy, publicity, personal or proprietary rights.
      • The views expressed by posters are those of members of the public and are not necessarily endorsed by us.
      If you breach these Terms of Use:

      If you fail to abide by these Rules, you will be sent an email which informs you why your contribution has been failed or edited. This mail will also include a warning that continuing to break the rules may result in action being taken against your account or accounts.       If you post or send offensive or inappropriate content anywhere on or to the Site or otherwise engage in any disruptive behaviour, and we consider such behaviour to be serious and/or repeated, we may use whatever information that is available to us about you to stop any further such infringements where we are required by law to do so or we consider it to be necessary. This may include informing relevant third parties, such as your employer, the relevant authorities or email provider about the infringement(s).

      We reserve the right to delete any contribution, or take any action against any account, at any time, for any reason.

      We reserve the right to monitor any posting made to or via the Site but shall not be obliged to do so, and you acknowledge we do not continually monitor the Site.

    5. In the event you have a complaint about any post, you should email us on [ ] copying the post you are complaining about and stating your reasons why. We will send you an email to acknowledge your complaint and shall take such action as we deem appropriate. If we uphold your complaint we may remove the post and associated postings and/or at our sole discretion take such action as we deem appropriate against the poster. Such response (of which we may but shall not be obliged to inform you) constitutes your sole remedy to any complaint and our entire liability to you. We shall not be obliged to reveal the identity of any contributor, although we may do so at our discretion or where required by any relevant authority.
    6. We reserve the right at any time to remove or partially remove or edit some, all or any of your postings.
  5. Our Responsibilities

    1. We will operate the Site with reasonable skill and care.
    2. We will do our best to maintain the operation of the Site, however, we may need to temporarily suspend the Site for operational reasons (e.g. for repairs, planned maintenance or upgrades).
    3. We reserve the right to make changes to the Site from time to time.
    4. If we cannot do what we have promised in this contract because of something beyond our reasonable control (including, without limitation, disputes involving our employees, strike, fire, flood, war, telecoms or other service provider failure), we will not be liable for this.
    5. We reserve the right to alter, suspend or discontinue any aspect of the Site or the content or services available through it, including your access to it. Unless explicitly stated, any new features including new content and/or the release of new software tools or resources shall be subject to these terms and conditions.
    6. We are not liable for the acts or omissions of any telecommunications or other service providers or for faults or failures in their network that render the Site unavailable, and such unavailability will not entitle you to any rebate or refund of any subscription fees paid.
  6. Information you provide

    1. The following applies to any information you provide to us, for example during any registration or ordering process:

You authorise us to use, store or otherwise process any personal information which relates to and identifies you, including but not limited to your name and address, to the extent reasonably necessary to provide the services which are available through the Site by us. We may collect information about you and if you send us personal correspondence such e-mails or letters or post reviews or other messages on the bulletin boards or in the chat areas then we may collect this information into a file specific to you (together, the various purposes set out in this paragraph and in our privacy policy shall be known as "the Purposes"). All such information collected by us shall be referred to in these terms and conditions as “Personal Information”.
      2. You must ensure that the Personal Information you provide is accurate and complete and that all ordering or registration details (where applicable) contain your correct name, address and other requested details.     2. By accepting these terms and conditions, you agree to the processing and disclosure of the Personal Information for the Purposes. You also agree that the Purposes may be amended to include other uses or disclosures of Personal Information following modification to you by means of a notice on the Site, which you should check regularly.   7. Security

    1. You are solely responsible in all respects for all use of and for protecting the confidentiality of any username and password that may be given to you or selected by you for use on the Site. You may not share these with or transfer them to any third parties. You must notify us immediately of any unauthorised use of them or any other breach of security regarding the Site that comes to your attention.
  8. Applicability of Online Materials

    1. Unless otherwise specified the materials published on the Site are presented solely for your private, personal and non-commercial use.
    2. The Site is controlled and operated by us from our offices in England. Where content published on the Site is supplied by third parties, including but not limited to contributors or members, you understand that we do not control or endorse their contents in any way. All content which is offered by third parties that are not affiliated with or otherwise connected with us, is published in good faith but we do not accept responsibility for the accuracy or otherwise of such content (whether published on or off-line) and the use of such content. You assume total responsibility and risk for your use of the Site and use of all information contained within it.
    3. We have used all reasonable endeavours to ensure that the Site complies with English law. However, we make no representations that the materials on the Site are appropriate or available for use in locations outside the United Kingdom and if you choose to access the Site from outside the United Kingdom you are solely responsible for ensuring compliance with all local laws, and you hereby indemnify us from any liability arising in connection with your use and access to the Site.
  9. Copyright and Monitoring

    1. The contents of the Site are protected by international copyright laws and other intellectual property rights. The owner of these rights is Dishing the Dirt LLP or other third party licensors. All product and company names and logos mentioned in the Site are the trade marks, service marks or trading names of their respective owners, including us. You may not reproduce, republish, upload, post, transmit or distribute, by any means or in any manner, any material or information on or downloaded from the Site including but not limited to text, graphics, video, messages, code and/or software without our prior written consent, except where expressly invited to do so, for example in order to complete any test or questionnaire. Where you post any material to the Site (including without limitation copies of other communications, photographs, excerpts from materials, etc.) you must first obtain the express written permission of the owner of such materials and by submitting such materials to the Site you are undertaking to us that you have done so and will indemnify us from and against any claim that any such materials are used without permission.
  10. Linked Sites

    1. We make no representations whatsoever about any other web sites which you may access through the Site or which may link to the Site. When you access any other web site you understand that it is independent from us and that we have no control over the content or availability of that website. In addition, a link to any other site does not mean that we endorse or accept any responsibility for the content, or the use of, such a website and shall not be liable for any loss or damage caused or alleged to be caused by or in connection with use of or reliance on any content, goods or services available on or through any other web site or resource. Any concerns regarding any external link should be directed to its website administrator or web master.
  11. Availability of the Site

    1. We will try to make the Site available but cannot guarantee that the Site will operate continuously or without interruptions or be error free and can accept no liability for its unavailability or errors on or in it. You must not attempt to interfere with the proper working of the Site and, in particular, you must not attempt to circumvent security, tamper with, hack into, or otherwise disrupt any computer system, server, web site, router or any other internet connected device.
  12. Liability

    1. In the absence of any negligence or breach of duty by us, your use of the Site is entirely at your own risk.
    2. We exclude all other express or implied terms, conditions, warranties, representations or endorsements whatsoever with regard to the Site or any information or service provided through the Site save as expressly set out in these terms.
    3. We will do our best to ensure that all materials and information published by us on the Site are accurate, but please note that all materials and information on the Site are provided on an “as is” basis, and we shall have the right to amend any errors that appear on the Site at any time. We are not liable for nor do we check the accuracy of any information posted to the Site by any third party AND EXPRESSLY EXCLUDE ANY LIABILITY IN CONNECTION WITH THE SAME. Any opinions expressed are those of the individual poster and are not endorsed by us.
    4. Subject to clause 12.5, we accept no liability for any indirect or consequential loss or damage, or for any loss of data, profit, revenue or business (whether direct or indirect), however caused, even if foreseeable. In circumstances where you suffer loss or damage arising out of or in connection with the viewing, use or performance of the Site or its contents, we accept no liability for this loss or damage (except where we have been negligent) whether due to inaccuracy, error, omission or any other cause and whether on the part of us or our servants, agents or any other person.
    5. Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence and each of the exclusions and limitations set out in these terms are subject to this provision. Save as set out in this clause, we have no liability for any statement made or displayed on this Site.
    6. You are responsible for ensuring that your computer system meets all relevant technical specifications necessary to use the Site and is compatible with the Site. You also understand that we cannot and do not guarantee or warrant that any material available for downloading from the Site will be free from infection, viruses and/or other code that has contaminating or destructive properties. You are responsible for implementing sufficient procedures and virus checks (including anti-virus and other security checks) to satisfy your particular requirements for the accuracy of data input and output.
  13. Release

    1. In the event that you have any claim or action against any other member arising from that member’s use of the Site, you agree to pursue such claim or action independently of and without any demands from us, and you release us from all claims, liability and damages, arising from or in any way connected to the claim or action.
    2. In the event that a claim or action is brought against us from your activities or use of the Site, including any breach by you of this Agreement or any charges or complaints made by other parties against you, you agree to pay, hold harmless and defend us in the claim or action. You also agree to cooperate as fully as reasonably required in the defense of any claim and allow us to assume the exclusive defense and control of the matter.
    3. You agree to indemnify us and any third parties for any and all losses, claims, costs, damages or expenses arising out of your use of this Site (whether authorised or otherwise).
  14. General

    1. We may assign, novate or sub-contract any or all of our rights and obligations under these terms and conditions at any time.
    2. These terms and conditions together with the privacy policy, any order form and payment method instructions, if any, are the whole agreement between you and us. You acknowledge that you have not entered into this agreement in reliance upon any warranty or representation made by us or any other person and you waive any rights to damages/rescission you may have for misrepresentation (other than a fraudulent misrepresentation) that is not contained in the terms and conditions, privacy policy, order form and payment method instructions. Variations to these terms shall have no effect unless expressly agreed in writing and signed by one of our directors.
    3. If any provision or term of these terms and conditions shall become or be declared illegal, invalid or unenforceable for any reason whatsoever, such terms or provision shall be divisible from the other terms and conditions and shall be deemed to be deleted from them.
    4. These terms and conditions and your use of the Site are governed by English law and you submit to the exclusive jurisdiction of the English courts. We will try to solve any disagreements quickly and efficiently. In the event of a dispute, which we are unable to settle, we reserve the right to request you attend formal mediation proceedings by serving you with written notice. Such mediation shall be carried out in accordance with the Centre for Dispute Resolution Model Mediation Procedure in force at the date of referral.
    5. Failure by either party to exercise any right or remedy under this agreement does not constitute a waiver of that right or remedy.
    6. Nothing in these terms shall confer any benefit nor the right to enforce any term on any party who is not a party to the order contract.
  15. Notices

    1. All notices shall be given:
      1. to us via email by clicking this link, or
      2. to you at either the email or postal address you provide during any registration process.

      Notice will be deemed received when an email is received in full (or else on the next business day if it is received on a weekend or a public holiday in the place of receipt) or 3 days after the day of posting.

  16. Replacement

    1. These terms and conditions replace all other terms and conditions previously applicable to the use of the Site.
